ICA maintains an extensive archival Library & Research Center, containing historical policy forms, insurance company literature and marketing material, and resources on the developing customs and practices in the insurance industry. Such documents have been found helpful to the Client in proving insurance company intent during policy drafting stage, which has often been the determining argument in resolving a case. As insurance claims have become larger and more frequently contested, these costs have a significant impact on a company’s bottom line. It is therefore critical to engage well qualified litigation support and expert witness services, even at the commencement of the claim/litigation process.

Provide objective, expert advice in insurance-related litigation, insurance coverage and claims handling issues.

Advise and testify on customs and practices in the insurance industry, including prevailing insurance regulations, underwriting criteria and accepted industry practice and broker standard of care and management issues.

Compare and analyze policy forms and endorsements for coverage and/or exclusions with respect to specific claims.

Assist in developing loss computations for property damage and business interruption losses and negotiate with Insurance company adjusters and accountants.

Research and draft Affidavits of Merit and Expert Witness Reports for submission to courts in support of the Client’s position.

Assist in auditing premium development under retrospective, deductible and other loss sensitive rating plans, as well as permissible rates and charges.

Provide assistance and advice to in-house and outside counsel during all stages of litigation.

Assist in managing documents for litigation, including recreation of old or lost insurance policies and endorsements, and provide other insurance archeological services, including the reconstruction of probable policy wordings in absence of a policy.
